Welcome

Questiory invites you to use our Beta version while we refine and enhance our platform that promotes digital storytelling through the combination of dynamic interactions and visualizations. Your insights and feedback as a user will be invaluable as we strive to create a digital product users enjoy and find helpful.

Questiory facilitates a dynamic and interactive digital ecosystem composed of two key participant groups: Authors and Players, throughout these Terms, we may refer to these participant groups generally as “users”.

Authors utilize Questiory to create, design, and share digital presentations. As content creators, Authors play a critical role in testing the platform’s capabilities, providing feedback, and showcasing the potential of Questiory through their unique creations.

Players are the end-users invited by Authors to experience and interact with the digital presentations they create. Players contribute to helping us improve Questiory indirectly by providing Authors, and thereby Questiory, with insights into the user experience, usability, and engagement levels of the content and platform features.

By using Questiory through any of these roles, you agree to abide by these Terms of Service. Please carefully read these Terms. If you do not agree with these terms, we recommend that you refrain from using Questiory.

Author Participation

As an Author using Questiory Beta, you will have the opportunity to gain early access to Questiory’s features. Your use of our Beta version will be instrumental in shaping Questiory into a tool that empowers and elevates the digital presentation experience for all users.

Benefits of participation for Authors

  • Early Access: Enjoy complementary access to Questiory’s features throughout the duration of the Beta Program.
  • Influence Development: Your feedback will directly inform future enhancements.
  • Showcase of your work: Opportunities to have your creations featured in Questiory’s website or promotional materials.
  • Community: Be part of a collaborative environment that values your contributions.

 

Author Contributions

As an Author we encourage you to:

  • Engage actively with the platform, exploring and evaluating its full range of features.
  • Help us understand product viability and product-market-fit by sharing your preferences and needs.
  • Provide constructive feedback and report any issues encountered.
  • Create content that demonstrates Questiory’s capabilities, adhering to content standards.

Account Terms

To become a Questiory user, you must be at least 13 years old. You’re responsible for your account’s activities. ‍By creating an account, you confirm that you’re (i) over 13, and (ii) authorized to agree to these Terms. You should not use Questiory on behalf of others.

Safeguard your login details and don’t share them. If you suspect unauthorized access, advise us as soon as possible by contacting our support team. ‍Don’t transfer your account to someone else or use it in a way that may harm Questiory, violate laws, or infringe on rights.

Content and Conduct

Acceptable Content

We value diverse content but expect safe and acceptable behaviour that maintains a safe and enjoyable environment for everyone.

It is important to ensure that your content complies with our Content and Conduct Terms. Failure to do so may result in suspension or cancellation of your account. ‍Your content includes but is not limited to any text, images and links that you as an Author, or the Players who interact with your presentations share. You should own or have rights to all content you include, not deceive or harm others and the content you include should not violate any laws. ‍

We appreciate your content and seek your permission to use it. By creating content, you grant us the right to use, display and share it. This right is global, royalty-free and indefinite. You must have all necessary rights to your content. Remember your content is public and might be shared.

Respectful Behaviour

Always treat others with respect and kindness. Be considerate of diverse opinions, backgrounds, and cultures. Harassment, discrimination, hate speech, or any form of harmful behaviour towards others will not be tolerated. ‍

Appropriate Content

Ensure that all content shared on Questiory complies with our Terms of Service. Avoid posting or linking to content that is offensive, explicit, illegal, or violates the rights of others, including copyright and intellectual property rights. ‍

Personal Information

‍Respect the privacy of others. When using Questiory, do not share or request personal information, such as addresses, phone numbers, or financial details.

Prohibited Activities

‍Engaging in activities that manipulate or abuse Questiory or the safety of others users, such as spamming, phishing, or spreading malware, is strictly prohibited. ‍

Authenticity and Attribution

Provide accurate and truthful information when creating Questiory presentations. Attribute any content or materials used from external sources appropriately and adhere to copyright laws. ‍

No Impersonation

‍Do not impersonate or falsely represent yourself as someone else or a representative of a company or organization when using Questiory. ‍

Reporting Inappropriate Behaviour

‍If you come across content or behaviour that violates our Terms of Service or seems inappropriate, please report it to our support team immediately. ‍

Moderation and Enforcement ‍

Questiory reserves the right to moderate and remove any content (partially or totally) created by users that violates these Terms of Service. Users who violate these terms may face account suspension or termination. ‍

Compliance with Laws

‍All users must comply with relevant local, national, and international laws while using Questiory. ‍

Data Responsibility

Authors are responsible for any data collected through their use of Questiory, ensuring compliance with applicable standards, customs and laws. We are not liable for content, products or services offered by Authors or Players.

Confidentiality

Authors agree to maintain the confidentiality of any proprietary information encountered during their involvement in this Beta Program and to prevent its unauthorized disclosure.

Intellectual Property

All intellectual property rights related to the Questiory platform and any feedback or contributions made by Authors remain the sole property of Questiory.

Program Modification and Termination

Questiory reserves the right to modify these Terms of Service, terminate an Author’s access at any time, for any or not specified reason, including but not limited to breach of these Terms of Service or the end, or any changes to this Program.

Use of Analytics and Third-Party Tools

Questiory is committed to continually improving the platform and providing a superior user experience. To achieve these objectives, Questiory employs various analytics tools, including but not limited to Google Analytics, Hotjar, Sentry, and New Relic (“Analytics Tools”). These Analytics Tools are used to collect data on how participants interact with Questiory, track usage patterns, identify areas for improvement, and diagnose technical issues.

Disclaimers and Limitations

No Warranty

Questiory is provided “as is,” without warranties of any kind.

Liability & Disclaimer

Questiory will not be liable for damages arising from the use of Questiory Beta or in relation to any content Authors and Players create using Questiory.

We are not responsible for your use of Questiory or for your content. You’re responsible for content backups. Use of Questiory and its content is at your discretion. Questiory is provided “as is” without warranties, including availability, merchantability, and fitness. ‍

We do not warrant: uninterrupted functionality, error correction or virus-free use; accuracy, reliability, or completeness of content.

Beta Nature of Software

Participants acknowledge that the Questiory platform is provided in its Beta version and is therefore subject to bugs, performance issues, and potential instability. Questiory endeavors to provide a reliable and functional service during the Beta Testing Program but makes no guarantees regarding uninterrupted or error-free operation.

Impact and Limitation of Responsibility

Authors and Players understand that their use of Questiory may be affected by these limitations. Questiory shall not be held liable for any direct, indirect, incidental, consequential, or other damages suffered by the participants or third parties as a result of using the Beta version of the platform. This includes, but is not limited to, data loss, data corruption, impact on content creation, or experiences of the end-users (Players). Participants are advised to maintain their own backups of any critical or valuable data to mitigate potential loss or corruption.

Data Loss or Corruption

Given the Beta nature of the Questiory platform, there is a risk of data loss or corruption. While Questiory takes measures to prevent such incidents, it cannot guarantee the complete safety of data created or stored on the platform during the beta phase. Participants should take proactive steps to secure their data, including regular backups and the use of additional data protection measures as deemed necessary.

Reporting Issues

Participants are encouraged to promptly report any bugs, errors, data loss, corruption, or other issues encountered during their use of the platform to assist Questiory in making necessary improvements and mitigating any adverse effects.

General Provisions

Amendments

Questiory reserves the right to update or modify these Terms and Conditions at any time so we encourage users to periodically review these Terms.

Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the participants (Authors and Players) and Questiory regarding the Beta Program and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

Governing Law

These Terms and Conditions shall be governed by the laws of the jurisdiction in which Questiory is incorporated, without regard to its conflict of law provisions.

Acknowledgment and Agreement

By participating in the Questiory Beta Program, participants affirm that they have read, understood, and agreed to be bound by these Terms and Conditions, including any future modifications.
